Overview

Welcome to The Point Bookstore. This website and store are operated by Turning Point Metroplex Fellowship, doing business as The Point Bookstore. The terms “The Point Bookstore,” “we,” “us,” and “our” refer to Turning Point Metroplex Fellowship and its operation of The Point Bookstore.

The Point Bookstore and Turning Point Church are assumed names, or DBAs, of Turning Point Metroplex Fellowship.

The Point Bookstore operates this website and online store, including the related information, content, features, tools, products, and services provided to customers. Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer products and services to you.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when accessing or using our website and services.

By visiting, interacting with, or purchasing from our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use our website or services.

1. Eligibility and Accounts

By using this website, you represent that you are at least the age of majority in your state of residence or that you have permission from a parent or legal guardian.

You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You agree that the information you provide will be accurate, current, and complete.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

2. Products and Availability

We make reasonable efforts to describe and display our products accurately. However, colors and product appearance may vary depending on your screen, device, lighting, and display settings.

Product photographs are provided for reference. Packaging, cover artwork, colors, materials, and other product details may occasionally vary from the images shown.

Product availability is not guaranteed. We may change or discontinue products, limit purchase quantities, or restrict sales when reasonably necessary.

Some products available through our physical store might not be available online, and some online products might not be stocked in our physical store.

3. Orders

Submitting an order constitutes an offer to purchase. We reserve the right to accept, decline, modify, or cancel an order when reasonably necessary, including for the following reasons:

  • A product is unavailable or incorrectly listed.

  • Pricing or product information contains an error.

  • Payment cannot be authorized.

  • An order appears fraudulent or unauthorized.

  • An order exceeds reasonable quantity limitations.

  • We cannot fulfill or ship the order.

Your order is not accepted until payment has been successfully processed and we confirm the order.

If we decline or cancel an order after payment has been processed, we will issue an appropriate refund. We will attempt to notify you using the email address, billing address, shipping address, or phone number provided with the order.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order has been processed, prepared for pickup, or shipped.

Returns, refunds, and exchanges are governed by our Return and Refund Policy.

4. United States Sales Only

The Point Bookstore currently accepts and ships orders only within the United States.

We do not knowingly accept orders requiring delivery to international addresses. We may cancel and refund an order if the supplied delivery address falls outside the United States or cannot be serviced by our available shipping carriers.

5. Prices, Taxes, and Payment

Prices, discounts, and promotions may change without notice. The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious errors.

Unless otherwise indicated, displayed prices do not include applicable sales taxes, shipping charges, or handling charges. These charges will be calculated and presented during checkout when applicable.

Prices available online may differ from prices offered in our physical store, at special events, or through third-party sales channels.

You agree to provide current, complete, and accurate billing and payment information. You represent that:

  • You are authorized to use the selected payment method.

  • The information you provide is accurate.

  • Charges incurred through your order will be honored.

  • You are responsible for the purchase price, taxes, shipping, and other disclosed charges.

We may offer promotions subject to separate terms. If promotional terms conflict with these Terms of Service, the specific promotional terms will govern that promotion.

6. Shipping, Delivery, and Local Pickup

Shipping and delivery dates are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, service interruptions, holidays, incorrect addresses, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional costs caused by an incorrect or incomplete address may be the customer’s responsibility.

If an order is lost, damaged, incorrectly delivered, or not received, please contact us promptly at hello@thepointbookstore.com so we can investigate and determine an appropriate resolution.

Eligible products may be offered for local pickup at The Point Bookstore. You should wait until you receive confirmation that your order is ready before arriving for pickup. You may be asked to provide your order confirmation or identification.

7. Returns, Refunds, and Exchanges

All purchases are governed by our published Return and Refund Policy.

Unless otherwise required by law or stated in that policy, purchases are final. Limited T-shirt size exchanges may be available within the period and under the conditions specified in the Return and Refund Policy.

Sale merchandise, clearance merchandise, gift cards, personalized products, and special-order items are final sale unless otherwise expressly stated.

8. Gift Cards and Promotional Codes

Gift cards and promotional codes are subject to any terms disclosed when they are issued.

Gift cards cannot be redeemed for cash except where required by law. Promotional codes have no cash value and may be subject to expiration dates, product exclusions, minimum purchase requirements, or other limitations.

We may reject or cancel gift cards or promotional codes that we reasonably believe were obtained, transferred, reproduced, or used fraudulently or without authorization.

9. Intellectual Property

The website and its content, including text, graphics, logos, photographs, video, audio, page designs, and original materials, are owned by or licensed to Turning Point Metroplex Fellowship and are protected by applicable intellectual-property laws.

Product images, descriptions, trademarks, and other materials supplied by publishers, manufacturers, distributors, Shopify, or other third parties remain the property of their respective owners.

You may use this website for personal, noncommercial shopping purposes. You may not reproduce, distribute, modify, republish, publicly display, sell, or commercially exploit website content without permission from the applicable rights holder.

The names and logos of The Point Bookstore, Turning Point Church, Turning Point Metroplex Fellowship, and their affiliated ministries may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without our prior written permission.

10. Optional Tools and Third-Party Services

Our website may provide access to tools, applications, payment services, rewards programs, or other features operated by third parties.

We do not control every third-party service and are not responsible for its independent operation, availability, security, or policies. Your use of a third-party service may be governed by additional terms and privacy policies from that provider.

You are responsible for reviewing and accepting any applicable third-party terms before using those services.

11. Third-Party Links

Our website may include links to websites operated by third parties. These links are provided for convenience and do not necessarily constitute an endorsement.

We are not responsible for the content, accuracy, security, availability, products, services, or privacy practices of third-party websites. Accessing a third-party website is at your discretion and may be subject to that website’s own terms and policies.

Questions or complaints regarding third-party products or services should generally be directed to the applicable third party.

12. Relationship With Shopify

The Point Bookstore’s online store is powered by Shopify, which provides the e-commerce platform used to offer products and services.

Sales made through this store are transactions directly between the customer and Turning Point Metroplex Fellowship, doing business as The Point Bookstore. Shopify is not the seller of the products offered by The Point Bookstore and is not responsible for the fulfillment, quality, safety, or delivery of those products.

Your use of Shopify-supported features may also be subject to Shopify’s applicable terms and privacy practices.

13. Privacy

Personal information collected through our website is handled according to our Privacy Policy.

Because Shopify hosts our online store, Shopify processes certain information associated with your access to and use of the store. Information may also be shared with payment processors, shipping providers, technology providers, and other service providers as necessary to operate the store, process orders, prevent fraud, and provide customer service.

Please review our Privacy Policy for additional information.

14. Customer Reviews and Feedback

If you submit a review, photograph, comment, suggestion, or other content to us, you represent that you have the right to submit that material and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

You grant Turning Point Metroplex Fellowship and The Point Bookstore a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute submitted content for operating, improving, and promoting the bookstore and its products.

You remain responsible for the accuracy and legality of content you submit. Submitted content must not be unlawful, defamatory, abusive, obscene, deceptive, or infected with malicious software.

We may monitor, edit, decline, or remove submitted content when reasonably necessary, but we are not obligated to publish or respond to every submission.

15. Errors, Inaccuracies, and Omissions

Our website may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, shipping charges, availability, or delivery estimates.

We may correct errors, update information, or cancel an affected order when reasonably necessary. If we cancel an order after payment has been collected, we will issue an appropriate refund.

16. Prohibited Uses

You may use our website only for lawful purposes. You may not use the website to:

  • Violate any applicable law or regulation.

  • Infringe intellectual-property or other legal rights.

  • Submit false, fraudulent, or misleading information.

  • Harass, threaten, impersonate, or harm another person.

  • Transmit viruses, malicious code, or other harmful material.

  • Send spam, unauthorized advertising, or deceptive solicitations.

  • Scrape, crawl, copy, or systematically collect website content or customer information without authorization.

  • Interfere with the security, operation, or availability of the website.

  • Circumvent purchasing restrictions or security features.

  • Make purchases using unauthorized payment information.

  • Use the website for fraudulent or abusive activity.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

17. Termination

We may suspend or terminate access to our website or services when reasonably necessary, including in response to suspected fraud, abuse, unlawful conduct, security threats, or violations of these Terms.

Termination does not eliminate payment obligations or other responsibilities that arose before termination.

Provisions that should reasonably continue after termination, including intellectual-property, disclaimers, limitations of liability, indemnification, and governing-law provisions, will remain in effect.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and online services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, accurate, complete, or error-free. Temporary interruptions may occur because of maintenance, technical failures, third-party services, or events beyond our control.

Products may also be covered by warranties provided by their manufacturers or publishers. Questions concerning a manufacturer’s warranty may need to be directed to that manufacturer.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, Turning Point Metroplex Fellowship, The Point Bookstore, and their employees, representatives, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products purchased through it.

This limitation does not apply where liability cannot legally be limited or excluded.

Nothing in these Terms limits your rights concerning merchandise that is damaged, defective, materially different from what was ordered, not delivered, or otherwise protected under applicable law.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Turning Point Metroplex Fellowship, The Point Bookstore, and their employees, representatives, service providers, and affiliates from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the website.

  • Your material violation of these Terms.

  • Your infringement of another person’s rights.

  • Content you submit through the website.

This provision does not require you to indemnify Turning Point Metroplex Fellowship or The Point Bookstore for their own unlawful conduct or negligence where prohibited by law.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed from the Terms. The remaining provisions will continue in effect.

22. No Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies referenced in them constitute the agreement governing your use of our website and online services. They supersede previous versions concerning the same subject matter.

23. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a reorganization, change of ownership, service-provider arrangement, or other lawful business purpose.

24. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable federal law controls.

Subject to any consumer rights that cannot legally be waived, disputes relating to these Terms or the services will be handled in courts with appropriate jurisdiction in Tarrant County, Texas.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or legal obligations.

The current version will be posted on this page. When required by law, we will provide additional notice of material changes.

Continued use of the website after an updated version becomes effective constitutes acceptance of the updated Terms.
